1. Acceptance of these Terms

By accessing or using Big Pictures Archive (the “Service”), you agree to these Terms & Conditions (the “Terms”). If you do not agree, do not use the Service.

2. About the Service

The Service provides access to a curated archive of images and related metadata, including celebrity and paparazzi-style imagery that may be licensed for permitted uses. Images and content are licensed, not sold.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

• You must provide accurate and up-to-date account information.
• You must not share credentials outside your organization’s authorized users.
• You must notify us promptly of suspected unauthorized access.

4. Purchases and licensing

Images and content are licensed, not sold. Your use is governed by the applicable licensing terms. See the Licensing Agreement.

You may only use content after purchase (or other written authorization) and only within the scope purchased (for example: media, territory, duration, and impressions).

5. Prohibited use

• Attempting to bypass access controls or scrape protected content.
• Using content without a valid license or beyond a license scope.
• Uploading malicious code or interfering with the Service.
• Violating applicable laws or third-party rights.
• Using content to imply endorsement by a celebrity or public figure.
• Using content to create deepfakes, face swaps, or synthetic depictions.

6. Editorial sensitivity and compliance

Some content may involve public figures, paparazzi-style capture, or sensitive situations. You are responsible for ensuring your use is lawful and appropriate, including compliance with defamation, privacy, publicity, and local media laws.

7. Intellectual property

The Service (including software, design, and trademarks) is owned by us or our licensors. Content available through the Service is owned by the respective rights holders and is provided for licensing subject to restrictions.

8. Third-party services

The Service may rely on third-party providers (for example: hosting, analytics, payment processing). Your use of those providers may be governed by their terms.

9. Privacy and cookies

10. Suspension and termination

We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms, the Licensing Agreement, or applicable law, or if needed to protect the Service, rights holders, or other users.

Intellectual property

The Service, including its design and underlying software, is owned by us or our licensors. Content displayed in the archive remains the property of its respective owners and is subject to license restrictions.

11. Disclaimers

The Service is provided on an “as is” and “as available” basis. We disclaim warranties to the maximum extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

13. Indemnity

You agree to defend and indemnify us from claims arising out of your use of the Service or content in violation of these Terms, the Licensing Agreement, or applicable law.

14. Governing law and jurisdiction

These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them shall be governed by the laws of the Hong Kong Special Administrative Region. Subject to any mandatory laws that apply to you, the courts of Hong Kong shall have exclusive jurisdiction.

15. Changes

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
